These Terms of Use (“Terms”) govern your access to and use of VegAI, including the VegAI mobile application, website, AI-powered tools, content, features, subscriptions, and related services (collectively, the “Service”).
The Service is provided by aicodebase, located at 8 The Grn # A, Dover, Delaware 19901-3618, United States (“VegAI,” “Company,” “we,” “us,” or “our”).
By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your country or state, you may use the Service only with the consent and supervision of a parent or legal guardian.
You are responsible for making sure your use of the Service is lawful where you live.
2. What VegAI Does
VegAI is an AI-powered plant-based food, nutrition, and meal-tracking service. Depending on the features available to you, the Service may allow you to:
- Log meals, food items, recipes, drinks, and nutrition information.
- Upload or capture food photos for AI-assisted food recognition.
- Receive estimated calories, macros, ingredients, meal insights, and nutrition suggestions.
- Set nutrition, wellness, fitness, weight-related, plant-based eating, or dietary preference goals.
- Receive meal ideas, recipe suggestions, shopping or ingredient suggestions, and personalized plans.
- Track progress and review your food history.
- Optionally connect Apple HealthKit, if you choose, to sync data such as weight, activity, or nutrition. This integration is off by default and the app works without it.
VegAI uses automation and AI. Results may be incomplete, inaccurate, or not appropriate for your personal circumstances. VegAI is not a food-safety service, allergen-detection service, medical device, nutrition counseling service, ingredient-certification service, or vegan or vegetarian certification service.
3. No Medical or Professional Advice
VegAI does not provide medical advice, diagnosis, treatment, nutritional counseling, or professional health services.
Any calorie counts, macro estimates, ingredient predictions, meal scores, recipe suggestions, dietary classifications, vegan or vegetarian suitability labels, health insights, or nutrition suggestions are provided for general informational and self-tracking purposes only. They are automated approximations and may be wrong. Our suggestions are designed to support healthy habits and wellness, but they are not a substitute for professional medical advice.
You should consult a qualified doctor, dietitian, nutritionist, or other licensed professional before making medical, dietary, weight-loss, fitness, or health decisions, especially if you have a medical condition, eating disorder history, allergies, are pregnant, are under medical supervision, or are following a prescribed diet. If you are experiencing or are at risk of a disordered relationship with food, please seek support from a qualified professional; VegAI is a self-tracking tool and is not designed to diagnose, treat, or manage eating disorders.
VegAI does not guarantee that any food, recipe, ingredient, or suggestion is vegan, vegetarian, allergen-free, safe for you, suitable for a medical condition, or compliant with a religious, ethical, or dietary requirement. You are solely responsible for checking labels, ingredients, allergens, restaurant information, and professional advice before eating or purchasing food.
Where the Service displays a reminder or banner, including on Food Detail screens, stating that AI results are estimates and that you should check ingredients, allergens, and vegan or vegetarian suitability before eating, that reminder is a safety notice only. It does not verify that a food is safe or suitable for you. You must check before eating, and you remain solely responsible for any decision to eat, purchase, prepare, or serve food based on the Service.
If you have allergies, food sensitivities, a medical condition, religious or ethical dietary requirements, pregnancy-related needs, prescribed dietary restrictions, or any other dietary limitation, you must not rely on the Service as your only source of information. You are solely responsible for independently verifying all ingredients, allergens, preparation methods, cross-contamination risks, labels, restaurant information, manufacturer information, and professional advice before eating, purchasing, preparing, or serving food.
You are solely responsible for your food choices, health decisions, and use of any information provided by the Service. You assume all risk arising from your reliance on the Service, including any risk related to inaccurate food recognition, missing or incorrect ingredients, inaccurate nutrition estimates, undisclosed allergens, cross-contamination, vegan or vegetarian suitability, dietary restrictions, health outcomes, food reactions, or decisions made based on AI-generated outputs.
Dietary classifications and labels
Where the Service applies a dietary label to a food, recipe, or ingredient, that label reflects our own automated, estimated criteria. It is not a certification and is not a guarantee. Labels are limited to the following and are estimates only:
- Vegan — estimated to contain no animal-derived ingredients.
- Vegetarian — estimated to contain no meat, poultry, fish, or shellfish, but may contain dairy, eggs, or honey.
- Plant-based — estimated to be predominantly plant-derived; not guaranteed free of all animal-derived components, and not equivalent to “vegan.”
- Pescatarian — estimated to contain no meat or poultry, but may contain fish, shellfish, dairy, eggs, or honey.
- Flexitarian — estimated to be predominantly plant-forward, but may include meat, poultry, fish, or shellfish.
Dietary classifications are not indicators of allergen safety. You must not treat them as confirmation that a food meets your ethical, religious, medical, or dietary requirements.
Allergen information
Where the Service provides allergen information, it attempts to identify, on an estimated basis only, the following allergens, and is limited to this list: gluten, milk, egg, peanut, tree nuts, soy, fish, shellfish, sesame, celery, mustard, lupin, and sulphites. Any allergen, substance, or component not listed above — including other nuts, cereals, fruits, legumes, additives, colorings, or flavorings — is not detected, assessed, or reported, and the Service makes no representation as to its absence. The Service cannot detect cross-contamination, trace amounts, processing aids, or undeclared ingredients. The absence of a given allergen in the Service’s output does not guarantee that it is in fact absent from the product. Always verify ingredients and allergen information directly with the manufacturer or provider before consuming.
4. Accounts and Security
You may need to create an account or sign in through a third-party provider such as Apple or Google to use some features.
If you use Sign in with Apple, Google Sign-In, or another supported login method, that provider may share account identifiers, email address, name, or authentication tokens with us so we can create and secure your VegAI account. Your use of those login providers is also subject to their own terms and privacy policies.
You agree to provide accurate information, keep your login credentials secure, and notify us promptly if you believe your account has been accessed without permission. You are responsible for activity under your account unless the activity was caused by our failure to use reasonable security measures.
You may initiate deletion of your account at any time from Settings in the app. In-app deletion is completed within 72 hours, subject to the data-retention terms described in our Privacy Policy. You may also contact us at hello@aicodebase.com; support deletion requests are processed manually and completed within 45 days.
5. User Content
“User Content” means any content you upload, submit, create, store, or transmit through the Service, including onboarding answers, food photos, meal logs, text, recipes, health or nutrition goals, dietary preferences, body measurements, feedback, and support messages.
You retain ownership of your User Content. By submitting User Content, you grant VegAI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, analyze, display, and use your User Content as reasonably necessary to operate, maintain, secure, personalize, troubleshoot, and improve the Service.
We do not use your User Content to train, develop, or improve AI or machine-learning models. We process it only to provide the Service to you, as described in our Privacy Policy.
You represent that you have all rights and permissions needed to submit your User Content and that your User Content does not violate any law, third-party right, or these Terms.
6. Food Photos and AI Processing
When you upload or capture a food photo, you confirm that you have the right to provide that photo to the Service. You should avoid including faces, children, private documents, payment cards, medical records, or other sensitive non-food information in food photos.
Food recognition and nutrition analysis may be performed by VegAI and third-party service providers acting on our behalf. AI-generated outputs are estimates only and may be incomplete or inaccurate. You should review and, where needed, correct AI-generated results before relying on them.
No food photo analysis, barcode result, ingredient prediction, meal insight, recipe suggestion, dietary classification, vegan or vegetarian suitability label, allergen-related statement, or nutrition estimate should be treated as a safety clearance, professional recommendation, or confirmation that a food is safe or suitable for you. You are responsible for checking before eating.
VegAI may ask onboarding questions about your goals, diet, age, height, weight, activity level, preferences, or restrictions to personalize your plan. You are responsible for providing accurate information and updating it when it changes. Personalization is not medical advice.
7. Prohibited Uses
You agree not to:
- Use the Service for medical emergencies or as a substitute for professional care.
- Use the Service as your only source for allergen, ingredient, vegan, vegetarian, medical, religious, ethical, safety, or dietary-suitability decisions.
- Upload unlawful, harmful, explicit, abusive, infringing, or privacy-invasive content.
- Upload images of other people without permission.
- Use the Service to harass, profile, discriminate against, or harm any person.
- Attempt to reverse engineer, copy, scrape, interfere with, or disrupt the Service.
- Circumvent payment, security, access, or usage restrictions.
- Use the Service to develop a competing product except where prohibited by applicable law.
- Misrepresent your identity or submit false information.
- Violate any applicable law, regulation, third-party platform rule, or intellectual property right.
We may remove content, restrict access, suspend accounts, or terminate accounts that violate these Terms or create risk for VegAI, users, or third parties.
8. Subscriptions, Billing, and Refunds
VegAI may offer free and paid features. Paid features may be offered through subscriptions, trials, one-time purchases, or other paid plans.
If you purchase through the Apple App Store, Google Play Store, or another third-party platform, payment processing, renewals, cancellations, and refunds are handled by that platform and are subject to that platform’s terms and policies.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period, at the price and frequency shown at purchase. If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription. You can manage or cancel your subscription, and turn off auto-renewal, in your platform account settings after purchase. Deleting the app or deleting your account may not cancel a subscription. You must cancel through the platform or payment method where you purchased.
We may change prices, features, or plans from time to time. If required by law or platform rules, we will provide notice before changes apply.
9. Third-Party Services and AI Providers
The Service may rely on or link to third-party services, including app stores, payment processors, analytics and attribution providers such as Adjust, cloud hosting providers, AI and search providers, authentication providers, customer support tools, and health platform integrations.
AI-powered food recognition, nutrition estimation, meal planning, recipe suggestion, and related search or enrichment features may be processed through third-party providers acting on our behalf. Current providers may include Google AI Studio and Exa.ai, depending on the feature and platform configuration. Where required by law, we will obtain your consent before sending your information to these providers, as described in our Privacy Policy.
We do not control third-party services and are not responsible for their content, availability, security, or practices. Your use of third-party services may be governed by their own terms and privacy policies.
10. Apple App Store Terms
If you downloaded VegAI from the Apple App Store, your use of the app is also subject to Apple’s applicable App Store terms, including Apple’s Standard End User License Agreement unless we provide a separate custom EULA.
Apple is not responsible for providing maintenance or support for the Service. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
11. Google Play Terms
If you downloaded VegAI from Google Play, your use of the app is also subject to Google Play’s applicable terms and policies. Google is not responsible for providing maintenance or support for the Service unless required by applicable platform rules.
12. Intellectual Property
VegAI and its licensors own all rights, title, and interest in the Service, including software, design, interfaces, trademarks, logos, text, graphics, models, databases, and other content, excluding your User Content.
These Terms do not transfer ownership of the Service to you. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own lawful, non-commercial purposes, subject to these Terms.
13. Feedback
If you send us ideas, suggestions, comments, or feedback, you grant us the right to use them without restriction or compensation to you, unless prohibited by applicable law.
14. Service Changes and Availability
We may modify, suspend, discontinue, or limit any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, secure, error-free, or available in every location or language.
15. Termination
You may stop using the Service at any time. You may initiate account deletion from Settings in the app, with in-app deletion completed within 72 hours, or contact us at hello@aicodebase.com to request deletion through support, which may take up to 45 days.
We may suspend or terminate your access if you violate these Terms, create legal or security risk, fail to pay applicable fees, misuse the Service, or if we discontinue the Service.
After termination, provisions that by their nature should survive will remain in effect, including intellectual property, disclaimers, limitation of liability, dispute terms, and payment obligations.
16. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, VegAI disclaims all warranties, whether express, implied, or statutory, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, security, health or dietary suitability, allergen detection, food safety, and compliance with vegan, vegetarian, religious, ethical, medical, or dietary requirements.
We do not guarantee that food recognition, calorie estimates, macro estimates, ingredient predictions, vegan or vegetarian suitability labels, allergy- or allergen-related information, meal suggestions, or other outputs will be accurate, complete, safe, or suitable for you.
We do not guarantee that the Service will detect or identify animal-derived ingredients, allergens, food sensitivities, hidden ingredients, additives, preparation methods, cross-contamination, mislabeled foods, restaurant errors, manufacturer changes, or any other factor that could make a food unsafe or unsuitable for you.
Safety notices, warnings, banners, labels, reminders, and other in-app disclosures are provided for general awareness only. They do not create any duty for VegAI to monitor, warn about, verify, or prevent any food, health, allergy, dietary, or purchasing risk.
You use the Service at your own risk.
17. Limitation of Liability
To the maximum extent permitted by law, VegAI and its affiliates, directors, officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for loss of profits, revenue, data, goodwill, health outcomes, business opportunities, emotional distress, personal injury, food-related illness, allergic reaction, dietary non-compliance, or other harm arising from or related to your use of or reliance on the Service.
To the maximum extent permitted by law, VegAI will not be liable for any claim arising from or related to your decision to eat, purchase, prepare, serve, avoid, or rely on any food, recipe, ingredient, meal, label, restaurant item, grocery item, nutrition estimate, dietary classification, vegan or vegetarian suitability label, allergy- or allergen-related output, health insight, recommendation, or AI-generated result.
The limitations above apply whether a claim is based on warranty, contract, tort, negligence, strict liability, statute, or any other legal theory, even if VegAI has been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
To the maximum extent permitted by law, VegAI’s total liability for all claims related to the Service will not exceed the greater of:
- The amount you paid to VegAI for the Service during the 12 months before the claim arose; or
- USD $100.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
18. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless VegAI from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your User Content, your misuse of the Service, your violation of these Terms, your violation of any law or third-party right, your food choices, your health or dietary decisions, your reliance on AI-generated outputs, or your decision to eat, purchase, prepare, serve, recommend, or avoid any food based on the Service.
19. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Service, you acknowledge our Privacy Policy.
20. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted with a new “Last updated” date. If changes are material, we may provide additional notice as required by law. Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.
21. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, unless your local consumer protection laws require otherwise.
Any disputes will be resolved in the state or federal courts located in Delaware, unless applicable law gives you the right to bring claims elsewhere.
22. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
23. Entire Agreement and Waiver
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VegAI regarding the Service and supersede any prior agreements or understandings on that subject. Our failure to enforce any provision is not a waiver of that provision, and no waiver is effective unless made in writing.
